These general contract and travel terms and conditions govern the legal relationship between you and the Matterhorn Gotthard Bahn (hereafter referred to as MGBahn) and the Rhätische Bahn (RhB) for travel arrangements made by the MGBahn/RhB or other services offered by MGBahn/RhB in their own name.
Reservation: The contract between the tour operator and MGBahn/RhB comes into force with the unconditional acceptance of the reservation by MGBahn/RhB (together with these general conditions and terms of travel).
Liability: The transport companies RhB and MGBahn, as operators of the Glacier Express, are liable solely within the framework of the legal provisions and only for damages in connection with company operations. All other forms of liability are excluded. Possible complaints during travel must be made immediately to the respective company. Claims for refunds or damages for defects or deficiencies not notified on the spot will not be entered into retrospectively. The transport companies are not liable for any programme change caused by unavoidable circumstances e.g. delays, blocked sections etc.
Conditions of payment: Basically, all services ordered are to be paid in advance by invoice, in cash or by credit card. Other conditions of payment are only permissible with prior agreement.
Cancellation charges: Various cancellation charges apply for booking cancelled less than 30 days prior to travel dates.
Arrival: You are solely responsible for your punctual arrival should travel to the Glacier Express not be included in your arrangement. No refund will be given for late arrival caused by traffic jams, heavy traffic conditions, delayed public or private transport, delays in entering the country, weather conditions or any other reason for which you are responsible.
Prices: Prices have been calculated on the basis of tariffs, prices and exchange rates valid at the time of going to print and include VAT. We reserve the right to amend prices accordingly for reasons for which we cannot be held responsible, e.g. newly imposed or increased taxes, changes in tariffs, currency fluctuations etc. The current EURO daily exchange rate will be used (invoice date) for accounting purposes.
Travel documents: Travellers are themselves responsible for complying with passport and visa regulations.
Insurance: Travelplan recommend that you take out baggage, accident and/or cancellation insurance
Applicable law and place of jurisdiction: Swiss law applies in the event of any possible dispute arising from this contract. The place of jurisdiction is recognised to be the domicile of the transport company, i.e. Brig, Switzerland.
